Immigration and the feds

Dumb as I think Arizona’s S.B. 1070 is, my first reaction to news of the administration’s plans to sue to overturn it is that it’s not obvious to me that the federal government has standing to sue.

Any real lawyers wanna tell me what the deal is?

  1. Not a lawyer but here is the deal.

Why the Obama administration is suing Arizona …
… not to mention refusing to secure the border. It wants illegal immigrants, or, wants them to become legal as quickly as possible (y’know, millions of new Democrat voters!). I mean check it — if you’re an illegal, the Obama administration is fighting for you

  2. It’s also true, although few will go on the record as saying so, that a lot of business owners (party breakdown not available, obvs) would prefer minimal enforcement against illegal immigrants AND their employers because a large supply of illegal immigrants = a large supply of cheap, intimidatable labor.

That’s not the question I was asking.

My question, rephrased to be a bit more precise, remains: Does the federal government really have standing to sue Arizona over its law? (And if so, how?)
